Welcome to CogniWerk.ai. These Terms of Use ("Terms") govern your access to and use of the services provided by CogniWerk.ai ("we", "our", or "us"). By using our platform, you agree to be bound by these Terms, which form a legal agreement between you and CogniWerk.ai. If you do not agree with any part of these Terms, you may not use our services.
CogniWerk.ai provides tools powered by generative AI to create various forms of digital media, including images, illustrations, animations, sound, text, video, and 3D models. Our platform uses a hybrid infrastructure combining proprietary technology and third-party services.
Access is based on a credit system, where each task consumes credits depending on its complexity, quality, and computational requirements.
By using our services, you confirm that you are at least 18 years old and legally able to enter into a binding agreement. If you represent an organization, you warrant that you have the authority to bind it to these Terms.
You must be 18 years or older to use CogniWerk.ai. We do not knowingly collect information from individuals under 18. If we discover such usage, we will terminate the account and delete related data. Suspicions should be reported to privacy@cogniwerk.ai.
Creating an account requires accurate and current information. You are responsible for all activities under your account and must protect your login credentials. Notify us immediately of any unauthorized use. Each user may hold only one account. Multiple accounts may be closed.
All payments are handled by secure third-party providers. Prices are listed in EUR and may include VAT depending on your location. All purchases are final and non-refundable unless legally required or in the event of a verified technical error.

Credit-Based Access
CogniWerk.ai uses a credit system to enable access to AI-powered services. Each task or generation request consumes credits based on complexity. Credits may be purchased, earned via promotions, or obtained through subscriptions.
Subscription Tiers
We offer monthly and annual subscription plans that include recurring credit allocations and premium features. Plan details are available on our pricing page
Automatic Renewal
Subscriptions renew automatically at the end of each billing cycle unless canceled in advance. By subscribing, you authorise us to charge your chosen payment method.

Payment Processing and Failures
Payments are securely processed by third parties. You must keep payment details current. If a payment fails:
Subscription Cancellation
You can cancel your subscription via your account or by emailing billing@cogniwerk.ai. Cancellation takes effect at the end of the billing period. No refunds or prorated credits apply. Your account will revert to the Free Plan or become inactive.
Credit Expiration
No Monetary Value or Transferability
Credits are not redeemable for cash, cannot be transferred, and have no monetary value.
You agree to use CogniWerk.ai in a lawful and responsible manner. You are responsible for ensuring that your use of the platform complies with all applicable laws and regulations. You are also responsible for the content you generate using the platform, including obtaining necessary permissions for any third-party materials you incorporate.
You must not misuse our services in any way, including but not limited to creating harmful, offensive, or misleading content, violating intellectual property rights, reverse engineering our software, or attempting unauthorized access. The use of automated tools, bots, or other means to interact with the platform is strictly prohibited.
If we discover that these Terms have been violated, we may suspend or terminate your account, remove infringing content, and forfeit your remaining credits. In serious cases, legal action may be taken.
As a user of CogniWerk.ai, you retain ownership of the content you generate, provided it complies with these Terms and applicable laws. You are free to use, modify, distribute, and commercialize the content you create.
By using our services, you grant CogniWerk.ai a limited license to use your inputs and outputs solely to provide and improve our services. Whenever we analyze user content or behavior to enhance the platform, we will, wherever feasible, anonymize the data to safeguard your privacy and ensure that individual users cannot be identified. We will not use your content for training AI models or for promotional purposes unless you have explicitly opted in to such use. Until an opt-in mechanism is available, no content you create will be used by CogniWerk.ai beyond the scope of delivering your results.
All underlying technologies, tools, designs, and intellectual property associated with CogniWerk.ai are either owned by us or licensed to us. You may not reproduce, redistribute, or reverse-engineer any part of our platform.
Some features of our service rely on third-party APIs and external model hosting. These providers may operate under their own terms and privacy policies. While we strive to ensure the reliability and security of these integrations, we cannot guarantee their performance or availability. Payment processing is also handled by third parties, and we do not store your full payment details.
Our use of third-party services does not imply endorsement. We reserve the right to modify or discontinue such integrations without prior notice.
CogniWerk.ai is committed to operating in accordance with the European Union's AI Act. Our systems are continuously assessed for their risk level and we take proactive steps to ensure compliance. This includes transparency about AI-generated content, providing human oversight, and taking measures to mitigate bias. We regularly evaluate the robustness, legality, and fairness of our systems.
We provide our services on an "as is" and "as available" basis. While we strive to offer a reliable and high-quality experience, we cannot guarantee uninterrupted or error-free access. To the maximum extent allowed by law, CogniWerk.ai shall not be held liable for any indirect, incidental, special, or consequential damages resulting from your use of the service.
Our total liability to you for any claims related to the service will not exceed the greater of €100 or the total amount paid by you to CogniWerk.ai in the preceding 12 months. We will make reasonable efforts to investigate and, if appropriate, restore credits lost due to verifiable system errors, but we do not guarantee such restoration.
By using our service, you agree to defend, indemnify, and hold harmless CogniWerk.ai and its affiliates from any claims, damages, losses, liabilities, and expenses arising from your violation of these Terms, your use of the services, or any content you generate that infringes on the rights of others.
CogniWerk.ai may update these Terms from time to time. When we make significant changes, we will provide at least 30 days’ notice via email or through a notice on our website. Your continued use of the service after the effective date of the revised Terms constitutes your acceptance of those changes. Minor modifications that do not materially affect your rights may be made without notice.
You are free to stop using the service at any time and may close your account. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, you will lose access to your account and any unused credits will be forfeited. Provisions that should reasonably survive termination will remain in effect.
These Terms are governed by the laws of Germany. Any disputes that cannot be resolved amicably will be submitted to binding arbitration under the rules of the International Chamber of Commerce (ICC), with proceedings held in Berlin and conducted in English. Class action lawsuits are not permitted under these Terms. We may seek injunctive or equitable relief in a court of competent jurisdiction to protect our intellectual property rights.
